Terms of Service
Effective October 18, 2026
These Terms of Service (the "Agreement") are a legally binding contract between you, the user (either an individual or a legal entity), and Odysseus Foundation ("Odysseus," "we," "us," or "our"). By accessing or using any services, forms, or information provided by Odysseus, including the website at www.odysseusfoundation.org and any related pages (together, the "Site"), you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree, you should refrain from using the Site.
01Who we are
The Site is operated by Odysseus Foundation, a Texas nonprofit corporation with its principal office at 223 West Wall Street, Suite 299, Midland, Texas 79701. You can reach us at hello@odysseusfoundation.org or (432) 242-6397. Our Privacy Policy, available on the Site, is incorporated into this Agreement by reference.
02Eligibility and minors
The Site and our programs are intended for college students, prospective college students, their parents and guardians, and supporters. Membership in our community is limited to enrolled or incoming college students, verified simply so the table stays genuine.
Use of the Site is available to persons who can form legally binding agreements under applicable law. If you are under the age of legal majority, you may use the Site and submit an interest form only with the knowledge and consent of a parent or guardian.
In keeping with federal law and Federal Trade Commission guidance on the privacy of young people, the Site is not designed for, and does not knowingly collect personally identifiable information from, children under the age of 13. If you believe a child under 13 has submitted information to us, contact us and we will delete it.
03Accuracy of information you provide
You warrant that any information you provide to Odysseus through the Site, including your name, email address, school, and year, is accurate, current, and complete, and does not misrepresent your identity or affiliation. Impersonating another person, or falsely representing your identity or your affiliation with any person, school, or entity, is prohibited.
04User conduct
You must comply with all applicable laws and regulations in connection with your use of the Site. Without limiting the foregoing, you are expressly prohibited from:
- using any "web scraper," "robot," "spider," or other automated or manual process to access, acquire, copy, or monitor any part of the Site or its Content, or to submit forms in bulk;
- attempting to reproduce, bypass, or circumvent the navigational structure or presentation of the Site to obtain materials, documents, or information through any means not intentionally made available;
- probing, scanning, or testing the vulnerability of the Site or any connected network, or breaching security or authentication measures;
- attempting to gain unauthorized access to any part or feature of the Site, any Odysseus server, or any other systems or networks connected to the Site, by hacking, password mining, or any other illegitimate means;
- taking any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Site or on Odysseus’s systems or networks, or interfering with the proper working of the Site;
- reverse looking-up, tracing, or attempting to trace any information about any other user or visitor, or exploiting the Site to reveal information other than your own;
- forging headers or otherwise manipulating identifiers to disguise the origin of any message or submission you send to Odysseus;
- using the Site or its Content for any purpose that is unlawful, fraudulent, or prohibited by this Agreement, or to solicit any illegal activity or any activity that infringes the rights of Odysseus or others;
- using the Site to harass, threaten, or harm any person, or to send unsolicited communications.
Odysseus reserves the right to block any such activity and to suspend or terminate access to the Site for anyone who violates this Agreement.
05Illustrative content
The students, testimonials, campuses, events, programs, statistics, and educational institutions depicted on the Site are illustrative. They were created for demonstration purposes only and do not represent real people, actual events or results, or any current affiliation with, or endorsement by, any university. University names, colors, and marks appear only to identify locations and are the property of their respective owners.
06Intellectual property rights
All content on the Site, including but not limited to text, graphics, logos, photographs, the Odysseus name, seal, wordmark and meander motif, audio and video, and software (collectively, "Content"), is the exclusive property of Odysseus Foundation or its licensors and is protected by copyright, trademark, patent, and other intellectual property and unfair competition laws. The Content encompasses the structure, design, selection, coordination, expression, and arrangement of such materials on the Site.
You may not copy, reproduce, republish, upload, post, publicly display, encode, translate, transmit, or distribute any part of the Site or the Content, including "mirroring" to other computers, servers, websites, or other media for publication, distribution, or commercial purposes, without the express prior written consent of Odysseus, except as explicitly allowed under this Agreement.
You may view, download, and print pages from the Site provided that you:
- do not remove any proprietary notice language from any copies;
- use the information solely for personal, non-commercial purposes and do not broadcast or display it in any media;
- make no modifications to the information; and
- make no additional representations or warranties relating to the Site or its Content.
07Linking to the Site
You may link to any page on the Site, provided the linked page opens in its own URL and is not framed or made to appear as part of your or any other site. Embedding Site content elsewhere without permission is prohibited. You may use the Odysseus name for linking purposes only; any other use of our logos, seal, or marks requires our express written permission, which may be requested at the contact address below. Odysseus reserves the right to refuse permission at its discretion and to require the discontinuation of any link to the Site for any reason.
08Forms and communications
When you submit a form, you consent to our contacting you by email (and by phone, if you provide a number) about the subject of your submission, such as dinner details, campus updates, or your gift. You may ask us to stop at any time by replying to any message or writing to the address below. How we handle the information you submit is described in our Privacy Policy.
You understand that internet transmissions are never completely private or secure, and that any message or information you send to the Site could be read or intercepted by others, even where a particular transmission is indicated as encrypted or secure.
09Gifts and contributions
Odysseus Foundation has applied for, but has not yet received, recognition as a tax-exempt public charity described in Sections 501(c)(3), 509(a)(1), and 170(b)(1)(A)(vi) of the Internal Revenue Code. Contributions are not tax-deductible unless and until that recognition is granted. Contributions made to Odysseus Foundation constitute irrevocable gifts and are not refundable, except where required by law or where a gift resulted from a processing error, in which case please contact us within 30 days. Odysseus exercises exclusive legal control over donated assets.
Online payments, when offered, are processed by a third-party payment processor under its own terms and privacy policy. We do not store full payment card numbers on our systems.
Odysseus does not provide individualized legal or tax advice. Please consult a qualified legal or tax advisor where such advice is necessary or appropriate.
10Third-party sites and services
The Site may link to third-party websites and services, including social media platforms and a payment processor. We do not control and are not responsible for their content, policies, or practices. Your use of them is at your own risk and subject to their terms.
11Disclaimers
Odysseus provides the Site and its Content on an "as-is" and "as-available" basis without any warranties, express or implied. Odysseus does not assure uninterrupted or error-free functionality of the Site or its Content, does not guarantee that defects will be corrected, and does not guarantee that your use of the Site will yield specific outcomes. Information on the Site, including events, schedules, and locations, is subject to change without prior notice.
To the fullest extent permitted by law, Odysseus disclaims all warranties, express or implied, including but not limited to warranties of accuracy, non-infringement, merchantability, and fitness for a particular purpose, and any warranty that the Site is free of viruses or other harmful components. Odysseus further disclaims any liability for the actions, omissions, or conduct of third parties in connection with your use of the Site.
Your sole remedy against Odysseus for dissatisfaction with the Site or its Content is to cease using it. This limitation of relief is a fundamental element of the agreement between you and Odysseus.
12Limitation of liability
To the fullest extent permitted by law, Odysseus Foundation and its directors, officers, employees, volunteers, host families, advisors, and agents will not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, or for any loss of data, goodwill, or profits, arising out of or relating to your use of or inability to use the Site, even if advised of the possibility of such damages, whether the claim is based on contract, tort, negligence, strict liability, or any other theory. This applies to damages caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft, destruction, or unauthorized access to or alteration of any record.
If, notwithstanding the foregoing, Odysseus is found liable for any damage or loss related to your use of the Site or any Content, its total liability will not exceed one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.
13Indemnification
You agree to indemnify and hold Odysseus Foundation, its officers, directors, advisors, predecessors, successors in interest, agents, affiliates, volunteers, host families, and employees harmless from any demand, loss, liability, claim, or expense (including reasonable attorneys’ fees) made by any third party due to or arising out of your breach of this Agreement, your violation of any law, your violation of the rights of a third party, or your use of the Site.
14Modifications to this Agreement
Odysseus reserves the right to alter, amend, add to, remove, or terminate any part of this Agreement at any time. Modifications are effective immediately upon posting on the Site, and the effective date at the top of this page reflects the latest version. It is your responsibility to review this Agreement periodically. Your continued use of the Site following the posting of any amendment signifies your acceptance of it. Subject to your ongoing compliance with this Agreement, Odysseus grants you a non-exclusive, personal, non-transferable, limited privilege to access and use the Site.
15Termination and suspension
Odysseus may, at its discretion and without notice: (1) modify, suspend, or terminate operation of or access to the Site, or any part of it, for any reason; (2) alter the Site, or any part of it, and any applicable policies or terms; (3) interrupt the operation of the Site as necessary to perform routine or non-routine maintenance, error correction, or other changes; and (4) restrict or block access to the Site for any person, including for any breach of this Agreement. Odysseus will not be liable to you or to any third party for any such action.
16Enforcement
Odysseus reserves the right to investigate and take appropriate legal action against any illegal or unauthorized use of the Site. A decision not to pursue action for a violation of this Agreement does not waive the Agreement or any legal right. In connection with any investigation or complaint regarding misuse of the Site, Odysseus may disclose information about you, including your identity, if it deems disclosure necessary to identify, contact, or bring legal action against someone who may be causing harm to or interference with the rights or property of Odysseus, its users, or the public, or as required by applicable law, regulation, legal process, or governmental request.
Odysseus may preserve and disclose any communication or data transmitted between you and Odysseus through the Site where required by law or where preservation or disclosure is deemed necessary to comply with legal process, enforce this Agreement, respond to claims that any data violates the rights of third parties, or protect the rights, property, or personal safety of Odysseus, its people, users, or the public.
If Odysseus initiates legal action against you due to your violation of this Agreement, Odysseus will be entitled to recover from you all reasonable attorneys’ fees and costs of such action, in addition to any other relief granted.
17Governing law and jurisdiction
This Agreement is governed by and construed in accordance with the laws of the State of Texas, without giving effect to any principles of conflicts of law. You agree to submit to the exclusive jurisdiction of the state and federal courts situated in Midland County, Texas, for any dispute arising out of or related to this Agreement or the Site, and you waive any objection to such jurisdiction or venue. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Any claim arising under this Agreement must be brought within one (1) year after the cause of action arises, or it is barred. In case of any controversy or dispute between Odysseus and you regarding the Site, both parties will attempt, promptly and in good faith, to resolve it. If the dispute is not resolved within thirty (30) days, either party may request mediation. If mediation fails, the parties are free to pursue any right or remedy available under applicable law.
18Miscellaneous
If any part of this Agreement is determined by a court or other competent authority to be invalid or unenforceable, that part will be modified or eliminated to the minimum extent necessary and replaced with a valid provision that best captures the intent of this Agreement, which otherwise remains in full force and effect. Odysseus’s failure to insist on or enforce strict performance of this Agreement does not constitute a waiver of any provision or right. This Agreement does not confer any rights or remedies on any third party. You may not assign your rights under this Agreement; Odysseus may assign its rights to a successor organization.
19Complete agreement
This Agreement, together with the Privacy Policy and any additional terms or policies incorporated by reference, constitutes the entire understanding between you and Odysseus with respect to the Site and supersedes all prior agreements and understandings, whether written or oral. Odysseus does not accept counter-offers to this Agreement, and all such offers are rejected.
